What if the construction permit is about to expire and the construction is not completed? Is it possible to extend the validity of a permit for the construction or reconstruction of an object?
The Town Planning Code of the Russian Federation provides for the extension of the validity of a building permit, provided that at least 7 working days remain before it expires. In this case, the developer or his representative, on the basis of a power of attorney drawn up in accordance with the legislation of the Russian Federation, must apply with the application for amendments to the building permit to the body that previously issued the building permit. Within 7 working days, the authorized bodies make a decision on amending the building permit or on the refusal, indicating the reasons for the refusal. To make a decision on making changes to the permit, the same documents are required as with the initial receipt of a building permit.
Do you need permission to build an individual residential building?
From 04.08.2018, in accordance with Federal Law dated 03.08.2018 No. 340-ФЗ “On Amending the Town Planning Code of the Russian Federation and Certain Legislative Acts of the Russian Federation”, obtaining permission to build an individual residential building is no longer required.
If you are going to erect a separate building no more than three floors and no more than twenty meters high, which has rooms and auxiliary facilities intended for domestic needs related to living, and you are not going to further divide it into independent real estate objects, then, in accordance with the Town Planning Code, this building will be an object of individual housing construction (hereinafter - IZHS).
In this case, you need to submit to the administration only a notice about the planned construction or reconstruction of the IZHS object or garden house, in which you indicate the following:
- Your surname, name, patronymic, place of residence, details of an identity document;
- cadastral number of the land plot (if any), address or description of the location of the land plot, as indicated in the certificate or extract from the USRN;
- documents of title to the land plot, if there are several owners, it is necessary to indicate all;
- type of permitted use of the land plot and IZHS object or garden house;
- the planned parameters of the IZHS object or garden house, including the indentation from the boundaries of the land plot;
- the assurance that the IZHS object or garden house is not intended for further division into independent objects;
- postal address and email address for communication;
The notification form approved by the federal executive body in the field of construction, architecture, urban planning (Ministry of Construction of the Russian Federation) can easily be found on the network.
Documents to be attached to the notice of planned construction:
- title documents for a land plot - a certificate of ownership or an extract from the USRN;
- power of attorney, if you are acting not on your behalf;
- if you plan to build on the territory of a historic settlement, you will need a description of the appearance of the IZHS object or garden house
Within seven working days from the date of notification of the planned construction, the administration checks the submitted documents and sends you a notification about the compliance of the IZhS object (garden house) with the established parameters and the admissibility of its placement on the land plot. This document will be your "permission".
