Who needs to apply for a building permit?

Individuals, both physical and legal, as well as their representatives (based on a power of attorney drawn up in accordance with the legislation of the Russian Federation) who are going to build, reconstruct or carry out major repairs, as well as carry out engineering surveys, and design them on their property rights or other property law, land plots. Such persons are developers.

Mandatory package of documents provided for obtaining a building permit:

 

  1. Application for a permit for the construction, reconstruction of the facility. For legal entities, it is necessary to draw up an application on the letterhead of the organization.
  2. Title documents for the land
  3. Consent to the processing of personal data, in accordance with the legislation of the Russian Federation.
  4. If reconstruction is planned and the object has several owners, then it is necessary to obtain the consent of all owners of the object.
  5. If reconstruction is planned in an apartment building, then according to housing legislation, the Decision of the general meeting of the owners of the apartment building is attached.
  6. If permission is obtained on the basis of adjusted project documentation, then confirmation from the design organization is necessary that the changes comply with the requirements of part 3.8 of article 49 of the Civil Code of the Russian Federation.
  7. If permission is obtained on the basis of adjusted project documentation, then confirmation from the expert organization is necessary that the changes comply with the requirements of part 3.9 of article 49 of the Civil Code of the Russian Federation.
  8. If, in accordance with Article 49 of the Civil Code of the Russian Federation, a Positive Expert Opinion is to be obtained for the project documentation, then a copy of it must be attached. An opinion can be obtained by contacting organizations accredited for the right to conduct an examination of the appropriate type.
  9. Be sure to attach to the application reports on engineering surveys, as well as the following sections of the approved project documentation:
    • Section 1 PP, explanatory note
    • Section 2 ROM, scheme of the planning organization of the land
    • Section 2 of the software, design of the right of way, if you plan to build a linear facility
    • Section 3 AR, architectural solutions
    • Section 4 of the Kyrgyz Republic, constructive solutions
    • Section 10 ODI, measures aimed at ensuring access for persons with disabilities to the capital construction facility
    • Section 6 PIC, construction organization project
    • Section 7 AML, demolition and dismantling organization project

The package of documents provided for obtaining a building permit voluntarily:

 

  1. Urban plan of the land plot or the project of the planning of the territory and the project of land surveying of the territory. Not required if the development of site planning documentation is not required for the construction of the facility.
  2. Permission for deviation from the limit parameters of permitted construction, reconstruction
  3. A positive opinion of the state examination of project documentation, in the absence, information is requested in the order of interagency interaction.
  4. A positive conclusion of the state environmental review, if it is necessary in accordance with part 6 of article 49 of the Civil Code of the Russian Federation, in case of absence, information is requested in the order of interagency interaction;
  5. If construction is planned on a built-up area where a decision on development or a decision on integrated development is made, a copy of the development agreement must be provided.
  6. Copies of title documents for the land, as well as a copy of the agreement on the establishment of easement or the decision to establish a public easement.
  7. A copy of the accreditation certificate of the organization that prepared the positive conclusion of the non-state examination, if the document is not provided, then the information is requested from the Federal Accreditation Service (Rosaccreditation)

What should I do if the building permit expires and the construction is not completed?

Is it possible to extend the period of validity of a permit for the construction or reconstruction of an object?

The Town Planning Code of the Russian Federation provides for the extension of the validity of a building permit, provided that at least 7 working days remain before it expires. In this case, the developer or his representative, on the basis of a power of attorney drawn up in accordance with the legislation of the Russian Federation, must apply with the application for amendments to the building permit to the body that previously issued the building permit. Within 7 working days, the authorized bodies make a decision on amending the building permit or on the refusal, indicating the reasons for the refusal. To make a decision on making changes to the permit, the same documents are required as with the initial receipt of a building permit.
